Terms of Service
Last updated May 8, 2026 · Effective immediately
1. Complete Acceptance of Terms
Welcome to Domzivo. These Terms of Service ("Terms", "Agreement") constitute a legally binding contract between you ("User", "Registrant", "Customer", "you", or "your") and Domzivo ("Domzivo", "we", "us", or "our"), governing your access to and use of the domzivo.com website, applications, APIs, and all related domain registration and management services (collectively, the "Services").
BY CREATING AN ACCOUNT, PURCHASING A DOMAIN, OR OTHERWISE ACCESSING OR USING THE SERVICES, YOU EXPRESSLY ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS, OUR PRIVACY POLICY, OUR COOKIE POLICY, AND ALL APPLICABLE ICANN POLICIES INCORPORATED HEREIN BY REFERENCE.
If you are entering into this Agreement on behalf of a company, corporation, or other legal entity, you represent and warrant that you possess the legal authority to bind that entity to these Terms. If you do not agree to these Terms, or do not have such authority, you must not accept this Agreement and may not use the Services.
2. Account Registration, Security, and Eligibility
2.1 Eligibility
You must be at least eighteen (18) years of age, or the legal age of majority in your jurisdiction, to create an account and use our Services. By using the Services, you represent and warrant that you meet this age requirement.
2.2 Account Information
You agree to provide true, accurate, current, and complete information during the registration process and to continually update such information to keep it accurate and complete. Providing false, fraudulent, or materially inaccurate information constitutes a material breach of these Terms and may result in the immediate termination of your account and the forfeiture of any registered domains without refund.
2.3 Account Security
You are solely and entirely responsible for maintaining the strict confidentiality of your account credentials (username, password, and 2FA tokens). You are entirely responsible for any and all activities that occur under your account, regardless of whether such activities were authorized by you. You agree to notify Domzivo immediately of any unauthorized use of your account or any other breach of security. Domzivo will not be liable for any loss or damage arising from your failure to protect your login credentials.
3. Comprehensive Domain Registration Policies
Domzivo provides domain name registration services by acting as a reseller and intermediary between you and accredited domain registrars and registries.
3.1 The Registration Process and Availability
Submission of an order and payment of the registration fee does not constitute a successful registration. A domain name is only successfully registered when you see it actively listed in your Domzivo dashboard and we receive confirmation from the central registry. The domain registration ecosystem is highly dynamic; adding a domain to your cart or beginning the checkout process does not reserve the domain. If a domain becomes unavailable before your payment successfully clears and the registry processes the command, we will refund the purchase amount to your account balance.
3.2 ICANN and Registry Policies
You acknowledge and agree that your registration and use of any domain name is subject to the policies, rules, and regulations of the Internet Corporation for Assigned Names and Numbers (ICANN), as well as the specific policies of the Top-Level Domain (TLD) registry operator. You agree to be bound by the ICANN Uniform Domain Name Dispute Resolution Policy (UDRP) and the Uniform Rapid Suspension System (URS), which are incorporated herein by reference.
3.3 Accurate WHOIS Data Requirement
ICANN mandates that all domain registrants provide and maintain accurate and reliable contact details (WHOIS data). You must provide accurate full names, postal addresses, email addresses, and voice telephone numbers for the Registered Name Holder, Administrative Contact, and Technical Contact. Failure to provide accurate WHOIS data, or failure to respond to inquiries concerning the accuracy of your data within fifteen (15) days, shall constitute a material breach of this Agreement and will result in the suspension or cancellation of the domain registration.
4. Renewals, Expirations, and Transfers
4.1 Renewal Obligations
It is your sole responsibility to ensure that your domain names and related services are renewed prior to their expiration dates. While Domzivo will make commercially reasonable efforts to send renewal notification emails to your registered email address (typically at 90, 60, 30, 14, 7, 3, and 1 days prior to expiration), we are not liable if you fail to receive these notices or fail to renew the domain. Once a domain expires, it may immediately cease functioning, and DNS resolution will be interrupted.
4.2 Grace Periods and Redemption Fees
Following expiration, certain TLDs may offer a brief Renewal Grace Period, followed by a Redemption Grace Period. If a domain enters the Redemption Grace Period, the registry operator imposes a significant redemption fee (often exceeding $100 USD) in addition to the standard renewal fee to restore the domain. If the domain is not restored during this period, it will be dropped by the registry and made available for public registration. Domzivo does not control these grace periods or registry fees.
4.3 Domain Transfers
You may transfer your domain to another registrar at any time, provided the domain is not within 60 days of initial registration or a previous transfer, is not subject to a legal dispute or hold, and is in an "unlocked" state. Domzivo reserves the right to deny transfer requests that violate ICANN's Transfer Policy or involve suspected fraud.
5. Strict Zero-Tolerance Abuse Policy
Domzivo is committed to maintaining a safe and lawful internet environment. We maintain a strict, zero-tolerance policy against the abuse of our network and services. You agree that you will not use any domain registered through Domzivo, or any associated DNS services, for any of the following prohibited activities:
- Spam and Unsolicited Email: Sending unsolicited bulk email, operating spam botnets, or engaging in email spoofing.
- Malware and Botnets: Hosting, distributing, or linking to viruses, trojans, ransomware, or operating command and control (C2) servers.
- Phishing and Fraud: Operating websites designed to trick users into revealing sensitive information, credentials, or financial data; operating advance-fee scams.
- Child Exploitation: Hosting, linking to, or distributing child sexual abuse material (CSAM). Such content will be immediately reported to the National Center for Missing & Exploited Children (NCMEC) and relevant law enforcement.
- Intellectual Property Infringement: Cybersquatting, typosquatting, or hosting content that blatantly infringes on valid copyrights, trademarks, or patents.
- Illegal Pharmacies: Operating unverified online pharmacies or distributing controlled substances illegally.
VIOLATION CONSEQUENCES: Domzivo reserves the right to immediately suspend, sinkhole, lock, or permanently cancel any domain name or user account found to be engaging in prohibited activities, without prior notice and without any refund. We cooperate fully with law enforcement agencies and cybersecurity researchers in combating abuse.
6. Strict NO REFUND Policy
Due to the immediate nature of our digital services and interactions with global registries, financial transactions on Domzivo are highly restricted.
- Domain Registrations and Renewals: Once a domain registration or renewal command has been successfully executed with the central registry, the action is permanent. Therefore, ALL SALES ARE FINAL AND NON-REFUNDABLE. We cannot issue refunds for typos, "buyer's remorse," or domains you no longer want.
- Business Email Services: Subscriptions for Business Email hosting are strictly non-refundable once the service has been provisioned. If you cancel your subscription, the cancellation will take effect at the end of your current billing cycle. No prorated refunds will be provided for unused time.
- Web Design Services: Custom web design projects are subject to the specific terms outlined in your project proposal. Generally, upfront deposits are non-refundable once design work or consultation has commenced, as they cover the immediate labor and resources allocated to your project.
- Wallet Deposits: Funds deposited into your Domzivo account balance (Wallet) are non-refundable to the original payment method. They remain available indefinitely for purchasing services on the platform.
- Chargebacks and Disputes: If you initiate a chargeback, bank reversal, or payment dispute for a valid transaction, we consider this payment fraud. Your account will be immediately suspended, all domains and services in your account will be locked, and you may be banned from using Domzivo in the future.
7. WHOIS Privacy Protection
Domzivo provides WHOIS ID Protection services (also known as Domain Privacy) to mask your personal contact details in the public WHOIS database. By utilizing this service, you agree that:
- Domzivo will forward legitimate communications to your underlying email address.
- You remain the legal registrant and beneficial owner of the domain name.
- Domzivo reserves the right to disable WHOIS Privacy and reveal your identity if legally compelled by a court order, subpoena, UDRP proceeding, or if we determine, in our sole discretion, that the domain is being used for abusive or illegal purposes.
8. Business Email Services
Domzivo provides professional Business Email hosting services. By utilizing these services, you explicitly agree to the following terms:
- Anti-Spam Policy: You must strictly adhere to our zero-tolerance policy against unsolicited bulk email (spam). Using our servers to distribute spam, phishing attempts, or malicious software will result in immediate, permanent account termination without refund.
- Storage and Backups: Your email storage is subject to the limits of your purchased plan. While Domzivo maintains infrastructure resilience, we do not guarantee indefinite retention of deleted emails. You are solely responsible for maintaining your own independent backups of critical business communications.
- Acceptable Use: Business email accounts must not be used as automated mass-mailing mechanisms, file hosting repositories, or for any activity that significantly degrades the performance of our shared email infrastructure.
9. ZIVO AI Domain Generator Disclaimer
The ZIVO AI Domain Generator is provided as an experimental tool to assist in brainstorming domain names. Domzivo makes no representations or warranties regarding the accuracy, availability, or legal safety of the generated suggestions. The generator may suggest names that are subject to third-party trademarks or intellectual property rights. It is your sole responsibility to conduct proper due diligence and trademark clearance searches before registering any suggested domain name. Domzivo bears no liability for any trademark infringement claims arising from your use of an AI-generated domain name.
10. Disclaimer of Warranties
Please read this section carefully as it limits our liability to you.
THE SERVICES ARE PROVIDED ON AN "AS IS", "AS AVAILABLE", AND "WITH ALL FAULTS" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, DOMZIVO DISCLAIMS ALL WARRANTIES, STATUTORY, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY OR RELIABILITY OF ANY DNS RESOLUTION OR THE CONTINUED AVAILABILITY OF ANY SPECIFIC TOP-LEVEL DOMAIN.
11. Limitation of Liability
IN NO EVENT SHALL DOMZIVO, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; (C) ANY UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; OR (D) THE LOSS OF REGISTRATION OR INTERRUPTION OF BUSINESS RELATING TO YOUR DOMAIN NAME.
IN NO EVENT SHALL DOMZIVO'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SERVICES EXCEED THE GREATER OF ONE HUNDRED US DOLLARS ($100.00 USD) OR THE AMOUNT YOU PAID DOMZIVO IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to defend, indemnify, and hold harmless Domzivo, its affiliates, and their respective officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (a) your use of and access to the Services; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including without limitation any copyright, trademark, property, or privacy right; or (d) any claim that your domain name or hosted content caused damage to a third party. This defense and indemnification obligation will survive these Terms and your use of the Services.
13. Dispute Resolution and Governing Law
13.1 Governing Law
These Terms shall be governed and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the state and federal courts located within Lagos, Nigeria.
13.2 Arbitration Agreement
Any dispute, controversy, or claim arising out of or relating to this Agreement, or the breach, termination, or invalidity thereof, shall be settled by arbitration in accordance with the Arbitration Rules of the Lagos Court of Arbitration. The number of arbitrators shall be one. The place of arbitration shall be Lagos, Nigeria. The language to be used in the arbitral proceedings shall be English.
13.3 UDRP Proceedings
Notwithstanding the above, any disputes specifically regarding the registration or use of your domain name (such as trademark infringement claims by third parties) shall be subject to the ICANN Uniform Domain Name Dispute Resolution Policy (UDRP) and/or the Uniform Rapid Suspension System (URS).
14. Modifications to the Service and Terms
We reserve the right to modify or discontinue, temporarily or permanently, the Services (or any part thereof) with or without notice. We reserve the right to modify these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.
